    DHS proposes ending USCIS deference on worker extensions

    DHS has proposed ending the deference USCIS gives prior approvals when deciding worker extensions — H-1B, L-1, O-1, TN and others. If finalized, officers would review each extension from scratch instead of starting from the last approval, which DHS estimates would mean thousands more Requests for Evidence a year. Foreign diplomas and other documents in the record would still need a complete English translation with the translator's signed certification. This is only a proposal so far, and comments are open through November 13, 2026.
